Chesapeake Bay Review Committee denies builder's appeal of the City's RPA delineation. It upheld the City's determination of RPA features and buffer boundaries.

Hampton City Council Unanimously Approves Zoning Changes (2nd and final reading).

The builder is granted a Land Disturbing Permit and begins to bring in countless truckloads of fill.

Builder forwards his appeal to the City of Hampton Board of Zoning Appeals (BZA). At the BZA Hearing, the Board unanimously rejects the builders appeal, upholding the City's RPA delineation and concurring with the findings of the Chesapeake Bay Review Committee hearing 12/20/07.

City issues a Stop-Work Order in mid-March for "dirty" fill, which the builder then removes and replaces with proper fill. City then revokes the Land Disturbing Permit altogether after builder removes dead trees and debris while still under the Stop-Work Order in addition to being outside of the scope of the permit.

The Chesapeake Bay Local Assistance Board met to vote on the City of Hampton's CBRA Ordinance Amendments that were unanimously approved by the Hampton City Council on January 9, 2008. The CBLAB voted in favor of the Amendments and agreed that they are consistent with the intent of the Chesapeake Bay Act. This is the State of Virginia's "Stamp of Approval"!

Builder had appealed the revocation of the Land Disturbing Permit. Conclusion of the Hearing, the City upholds that appeal.
9/12/08
In the lawsuit that the Builder brought against the City of Hampton, Judge Taylor rules in favor of the City. He ruled that the City has the authority to uphold the CBRA Ordinance Amendments.
There has been no land disturbing or building activity in this area since the City revoked the Builder's Land Disturbing Permit in April, 2008. The White Marsh Group continues to meet with City Officials to work towards our ultimate goal of protecting this fragile area.
